Terms and Conditions

The terms and conditions govern all transactions between HallStone Logistics and the customer. In the event of any inconsistency between these Terms and Conditions and any other agreement, including but not limited to a Service Level Agreement, Purchase Order, or any other document, these Terms and Conditions shall prevail unless expressly agreed otherwise in writing by HallStone Logistics.

Insurance

​​​All vehicles HallStone Logistics move, or are in possession of, are insured under our “A” rated insurance policy but this does not extend to damage such as stone chips or punctures caused by road debris.

 

Our Public Liability is £10,000,000 and our Road Risk for a vehicle being Driven is £100,000. (Provisions can be made for any vehicle above £100,000 but you will need to stipulate this when making the booking)

It is the duty of the customer to ensure that all vehicles to be moved by HallStone Logistics are roadworthy and have a current/valid MOT at the time the vehicle is due to be moved by Motor Trade Logistics.

Waiting Time

 Waiting time is charged to the customer/dealer at a rate of £20 + VAT per 60 minutes, after the first 60 minutes has lapsed. This is charged to the customer/dealer as it causes a delay in the delivery specialists day, therefore affecting there scheduled jobs.

Electric Vehicles

Electric vehicles quite often need charging between collection and delivery, therefore we charge a waiting time fee of £20 + VAT per hour. The Waiting Time fee is charged in association with the amount of electricity the vehicle requires, depending on the Charging Point speed, the time/price differs.

The EV Charging cost is charged to the customer in the same manner as Fuel. Please be aware that drivers may need to charge the vehicle multiple times, as well as additional milage due to the delivery specialist having to find Charging Points.

Liability For Road Debris Damage

The company takes all reasonable precautions to ensure the safe transport of vehicles, however, the nature of road travel means that certain risks, such as damage caused by road debris, are beyond our control:

- The company shall not be held liable for any damage to vehicles  resulting from road debris, loose stones or other external factors encountered during transit

- This includes, but is not limited to stone chips, scratches, dents, punctures or other impact damage sustained while the vehicle is in motion

​

- The customer acknowledges and accepts that such risks are inherent in vehicle transportation and that the company will not be responsible for repair costs associated with road debris damage

Motor Offences

While the vehicle is under the control of HallStone Logistics, we are liable for Speeding Fines, Toll Charges and Parking Tickets. The registered keeper will receive the enforcement notice relating to the relevant offence. It's important that the individual that receives the notice complies with the law and fills in the relevant section/s.

HallStone Logistics will pay any of the above offences as long as the registered keeper has requested the correct information and completed the form in a timely manner. However, if the offence/form has been ignored by the registered keeper and therefore escalated, HallStone Logistics will only be liable for the original offence charges.

 

Unless the registered keeper of the vehicle has absolved there liability by completing the correct sections on the notice, they will always be liable under English Law. 

Vehicle Collection & Inspection

When we move a vehicle, we aways complete an inspection form for the condition of the exterior of the car that both parties have to sign. The inspection form is a report of the vehicles cosmetic condition that our delivery specialists are trained to complete. If one of our delivery specialists misreports a defect on the inspection form, HallStone Logistics are responsible.

If the vehicle is inspected in poor weather conditions or excessively dirty on collection, it may not be possible to produce an accurate inspection form, this would be noted on the digital inspection form, therefore HallStone Logistics will not be responsible for any damage subsequently identified.

On delivery of the vehicle, our delivery specialist will ask you to sign a vehicle condition report. Once the vehicle has been inspected and the inspection form has been signed by you or by a representative of your company, HallStone Logistics will have no further liability and cannot be held liable for its condition or be responsible for any future claims as to its roadworthiness, mechanical or cosmetic condition.

Vehicle condition reports or vehicle appraisals are based on the opinions of the delivery specialist following a visual assessment as to the condition of the vehicle at the time of the inspection. If the purchaser/buyer has requested a telephone appraisal, it is the purchaser/buyers responsibility to ask the delivery specialist to check items that are standard or non-standard items. The purchaser/buyer may ask our delivery specialist to check the V5, number of keys and the service books/histories. Where a road test is conducted the report is based on the opinions of the delivery agent in the limited time allowed to get the vehicle up to the normal operating temperature. 

Breakdown Cover

Where breakdown cover has not been taken out and a breakdown occurs, £150 plus VAT or £1.80 a mile plus VAT, whichever is the higher, will be charged to get the vehicle to its onward destination. Any chargeable parts/lubricants required by the breakdown agent to ensure the onward movement for the job to be completed are chargeable to the Customer.

Mechanical Condition

HallStone Logistics cannot be held responsible for the mechanical condition of a vehicle that they have been instructed to move or for any mechanical defect encountered whilst the vehicle is in transit. Our delivery specialist relies on the accuracy of the vehicles warning lights or a multi-function display and will take all reasonable measures to protect themselves and the vehicle they are moving.

Driving specialists are instructed to find a safe and suitable area to pull over at should the vehicle encounter a fault. 

Job Cancellation

​The full cost of the movement is chargeable unless a minimum of 24 hours advance notice is provided. For the purposes of this notice period, only business days (Monday through to Friday) are counted; weekends (Saturday and Sunday) along with UK public holidays cannot be counted toward the required 24 hours.

Invoicing

If you are not an account holder you can pay for movements as you require them. If you have an account withHallStone Logistics our invoices are due no longer than 30 days after the invoice has been raised, jobs are invoiced by our system the week they are completed. If an agent or representative from your company has instructed us (verbally or written) to complete a movement but has not supplied us with an order number the invoice is still due on the due date.

HallStone Logistics reserves the right to amend, update, or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any amendments constitutes acceptance of the revised Terms and Conditions.
